Terms and Conditions of Use

1. Acceptance of the Terms

By accessing, browsing, or using the MeuDesk platform, requesting a demo, or contracting our dedicated private server services, you acknowledge that you have read, understood, and voluntarily accepted, without reservation, these Terms and Conditions of Use in their entirety. If you do not agree with these terms, you must refrain from using the website and our services.

3. Purpose and Description of the Service

MeuDesk provides remote desktop solutions, remote technical support, and the provisioning of 100% dedicated private server infrastructure for companies and organizations. Unlike traditional multitenant SaaS platforms, MeuDesk provisions fully dedicated and isolated instances for each client, ensuring that performance, connections, and data are never shared with third-party companies.

4. Registration and Account

To request a demo or contract a dedicated server, the client agrees to provide truthful, accurate, and up-to-date information. The client is solely responsible for safeguarding the credentials, private keys, and device IDs granted for connecting to their equipment.

5. Plans, Pricing, and Payments

The technical specifications, provisioning costs, and term of the dedicated private server will be established in the commercial offer approved by the client. Payments will be made in advance according to the agreed terms. Failure to pay or payment delays will result in the temporary or permanent suspension of the dedicated services.

6. Acceptable Use

The user agrees to use the service diligently and lawfully. The following is expressly prohibited:

• Using the platform for unauthorized access to or control of third-party computer systems.
• Transmitting malicious code, malware, spyware, or viruses through the remote client.
• Using the private server for illegal activities or the violation of the fundamental rights of others.
• Reverse-engineering or decompiling the software without prior written authorization.

7. Dedicated Private Servers and Infrastructure

Yeira Navarro provisions and maintains the contracted private infrastructure. Each dedicated server has compute and network resources assigned exclusively to the client. The client understands that we do not intercept or store the end-to-end encrypted traffic that flows through their remote sessions.

8. Intellectual Property

All intellectual and industrial property rights over the website meudesk.com, the MeuDesk brand, logos, designs, source code, and documentation belong exclusively to Yeira Navarro or its licensors. No element contained in the service shall be construed as a transfer or assignment of copyright.

9. User Content and Data

The client retains full ownership and control over all data, files, and information transmitted or processed during remote support sessions. MeuDesk assumes no responsibility for the content of sessions managed by the user.

10. Availability, Changes, and Suspension

We strive to maintain continuous and optimal availability of the dedicated servers (targeting 99% uptime). However, the service may be temporarily suspended due to scheduled maintenance, security improvements, or force majeure events.

11. Warranties and Limitation of Liability

The service is provided "as is" and as available. To the maximum extent permitted by applicable law, Yeira Navarro shall not be liable for indirect or incidental damages, loss of profits, or data loss resulting from internet connectivity interruptions or the user's negligent use of the remote client.

12. Indemnity

The client agrees to hold harmless and defend Yeira Navarro against any claim, demand, penalty, or cost (including attorneys' fees) arising from the improper or unauthorized use of the tool by their personnel or authorized third parties.

13. Personal Data Protection

The collection and processing of personal data are strictly governed by our Privacy Policy, in compliance with Law 1581 of 2012 of the Republic of Colombia and applicable data protection regulations.

14. Amendments to the Terms

We reserve the right to update or modify these terms at any time. Any change will be published promptly on meudesk.com, indicating the date of the last update.

15. Governing Law and Dispute Resolution

These Terms and Conditions are governed by and interpreted under the laws of the Republic of Colombia. Any dispute or controversy related to this agreement that cannot be resolved amicably and directly shall be submitted to the ordinary jurisdiction of the competent authorities and courts of the city of Bogotá, D.C., Colombia.
